Clean Water Act: EPA and Army Corps issue proposed rule

 On March 25, 2014, the EPA and US Army Corps of Engineers issued a very important proposed rule under the Clean Water Act to clarify and interpret the Supreme Court's decisions of 2001 and 2006 defining what are "waters of the US." CWF is preparing comments and will post.

EPA spent 3 years developing the proposed rule which means situations in which no Section 404 dredge and fill permit is needed. The public comment period has been extended and will end on October 20 and EPA expects to finalize the rule in 2015.  "The interpretive rule for agricultural activities is effective immediately."
